If the apartment building is Waqf (endowment),
then the rent is to go to the beneficiaries stipulated by the person who made the endowment and in conformity with the Shari`ah. If the property was privately owned by the deceased, then the proceeds are to be divided according to the prescribed shares of each heir. You must rectify the past division and take the extra sums from those whom you have given more than their share and give them to those whom you have given less than their share unless they waive their right. In future, you must implement the accurate division of the proceeds, whether they are from an endowment or from inheritance.May Allah grant us success.
